Introduction :
Baniyas is the largest district of Tartous Governorate in Syria, with an area of 720 km2, and a population of nearly 177,000. This population is comprised of 105,000 Alawites, 45,000 Sunnis, and 20,000 Christians.
Baniyas is a junction point between other cities of Syria. The international highway is between Lattakia and Tartous and connects other internal governorates by Al-Qadmus – Misiaf high way ( which are Alawite villages)
Entrances to the city:
Eastern (Qusor neighborhood): inhabited by Alawite sect
North (Hrison): Majority Alawite and Minority Sunni
Southern Entrance is bordered by a Thermal Station
Baniyas divided into four districts:
Villages centre district ( Baniyas district) Multi-denominational

The Report:
In this report, we rely on the testimonies of a few survivors and cite witnesses in addition to several phone calls and texts of more than 7 activists on the ground. But to this moment, we could not visit the scene, but we have asked for, and got, a large number of recordings, photos and videos of survivors’ testimonies and then compared with videos and photos we got via our official email ( you can find attached to our report)
Banyias massacre continued over 3 days. It started on Thursday, May 1, 2013, until May 4, 2013. Horrible events occurred on each day
Ethnic cleansing occurred in Sunni Districts:
1- Al-Bayda village: On May 2, 2013, a massacre took place in Bayda, SNHR could document by name and photo 263 civilian victims, including 43 children, and 28 women, all of them from Bayda
2- Ras Alnabaa village: On May 4, 2013, a massacre took place in Ras Alnabaa. SNHR documented 196 civilian killed, including 63 children and 43 women. They were killed by shelling, which was followed by other methods of murder and ethnic cleansing
Thus, the death toll of the ethnic cleansing massacre in Baniyas is 458 civilians; including 93 children and 71 women
Details about the first massacre: Al-bayda village
It is systematic that Syrian Government’s Armed Forces punish civilians from any area they clashes with their troops,
dozens of threats to civilians through loudspeakers in all Syrian territories if shot one bullet against them from any area, then they will exterminate the whole area and as doing that they just want pretext to explode
This acts violate Customary IHRL, the applicable law in armed conflicts:
Rule 1. The parties to the conflict must always distinguish between civilians and combatants. Attacks may only be directed against combatants. Attacks must not be directed against civilians.
Rule 2. Acts or threats of violence the primary purpose of which is to spread terror among the civilian population are prohibited.
Rule 6. Civilians are protected against attack, unless and for such time as they take a direct part in hostilities.
Rule 7. The parties to the conflict must always distinguish between civilian objects and military objectives. Attacks may only be directed against military objectives. Attacks must not be directed against civilian objects.
Rule 10. Civilian objects are protected against attack, unless and for such time as they are military objectives.
In the early morning on Thursday, May 2, 2013, a small clash occurred on a military checkpoint near Al-Baiyda between few Armed rebel’s fighters and Syrian Government’s Armed Forces
( Noting that Baniyas is one of the most peaceful areas in Syria, cause it is Multi-denominational there is no armed opposition there)
After one or two hours Syrian Government’s Armed Forces surrounded Al-Baiyda town and started the usual three phases before every massacre:
1- Siege, shelling, cut off electricity and communications
2- Stormed
3- Extrajudicial killings, slaughter, looting and arrest
According to survived family who fled from death in the massacre, some of them now in Turkey, they said: amid total cut off electricity and communications; Syrian Government’s Armed Forces shelled the town for several hours, then they started storming the town accompanied by security forces, Shabiha from the neighboring Alawite villages and members of Lebanese Hezbollah (were recognizable cause of their Lebanese accent) and begun terribly slaughtering, killing and executing people, using knives, cleavers, edged weapons and even smashing head to death with stones and then they burned many of the corpses.
(Noting that inhabitants of AL-Baiyda is almost 6000 people)
This massacre is considered to be the worst massacre in the history of the Syrian Revolution. They slaughtered, distorted, cut the organs of children and women then burned and then dumped the corpses on top of each other in streets
On the next day: Friday, May 3, 2013, almost at 10.00 am, again random shilling and missiles on the town, and dozens of people tried to flee across the orchards.
They again stormed the village from Ajamah mountain’s axis, and Marah village’s axis (Christian majority) who didn’t participant in the massacre or was not killed because the explicit order was to kill only Sunni people. They then slaughtered civilians with knives, cleavers and field executions lasted to nearly 2 PM, of course prevent Friday prayers ritual.
Large number was not immediately killed, but they were arrested and taken to Alzoba Alawite village, where we received news that they were killed there
Their corpses remained on the streets and in houses, where they rotted
Many houses and cars have been burned
After that another Syrian Government’s Armed Forces chased the families who fled from Al-Baiyda to orchards and neighboring towns, launched raids, prosecutions and arrests in those areas: Agricultural Wata Albaida area and Sahm Albahr area, we got news about executions there, but we couldn’t get eye witnesses or survivors to confirm
Syrian Government’s Armed Forces imposed a suffocating siege on Markeb and Basatin villages, they arrest dozens of citizens especially in the upper neighborhood of the village, where they took a large number of families (men, women, children) to Alkaokab village, while they were beating, assaulting and abusing them, them they allowed children and women to return to their villages on foot. One of the parents told us that the reason for setting free children and women is to keep them as a hostage when they need.
Looting and arresting continued for two days (Friday and Saturday), families saw trucks loaded with furniture conveyed to Alawite towns.

“Regime’s Forces burned my uncle and all of his children before me, they burned them alive,” he said
The people made sure that one of the massacre’s chief instigator and overseer nicknamed (Ali al-Kayyali), the real name is Mihraç Ural, Alawite of Turkish origins from Antakya

Ras Alnabaa: poor neighborhood, almost 400 m2 linked with Baniyas in two ways: 1-bridge known as Ras Alnabaa bridge, 2- and high way
In Thursday, May 2, 2013, when the residents in Ras Alnabaa heard frequent news about the shelling and killing in Al-Baiyda, most of them took their belongings and fleed from the neighborhood to escape from death
When the residents tried to escape through the bridge, Syrian Government’s Armed Forces at the bridge barrier prevented them, and arrested all of them They separated women, children and elders, and order them back to the neighborhood, tortured and humiliated men, and ordered them to return to the neighborhood.
They tried to flee once a few days ago before the massacre, but they were prevented.
In this report, SNHR relies on testimonies of few survivors, the most important is Abo Mohammad’s testimony
Friday on May 3, 2013, after Syrian Government’s Armed Forces prevented dozens of families from fleeing across the bridge on Ras Alnabaa – many of them used the highway to flee
On Friday, noon, approximately at 2: 30 PM, Syrian Government’s Armed Forces started the usual phases before every massacre Siege, shelling, cutting off electricity and communications, storming, killing, slaughtering, looting, arresting, and burning
Heavy artillery was erected at the bottom of Ras Alnabaa bridge and another artillery at AlQoz bridge with few tanks, suddenly without any alarm deliberately started shelling the local residents’ houses heavily, because no one was there, heavy gunfire continued for about one hour
After shelling, they initiated the next phase, where almost 1000 fighters performed a house to house raid. They started executing, killing, and slaughtering families. Entire families were annihilated
Abo Mohamad Told us:
“Storming started at 2:30 PM, Intruders were wearing black T-shirts and camouflage trousers, I saw them with my own eyes, I know some of them and I know their families, as Zahraa, Marouf, Shamali, Haidar families and others, they entered in regiments of 200, then 150, then 200, they stormed the town with trucks, they gathered in Al-Qusor Alawite neighborhood, they started to expel families of their houses, and executed them directly, it took five minutes to execute each family.
There was a child, they split him from his head to the middle of his back
I watched a young man, they threw him on the ground and then they swooped on him to stamp him with knifes
I watched a woman, I know her family, she is well known in the neighborhood, they took off her clothes and raped her, I saw that in my eyes, then they cut her hand, and they half slaughtered her.
They burned one of the shops, they threw four children after cutting them, they also threw a girl into the fire while she was alive.
I am trying to summon up my strength and memory… there was a whole family, they ordered them to turn their faces to the walls, when they were loading their Russian weapons, a woman fell to the ground and survived, she is still alive.
I estimated the number of the killed and slaughtered people whom I saw with my eyes from neighbors and relatives about 250 victims, there are many areas in the neighborhood that I couldn’t see.
Killing and slaughtering continued until 1 am, after midnight, after that in a while I escaped with my family through mountain, I knew then later that they allowed some of the survived residents to flee across the Corniche Street.
How could we live with them, joke and laugh, eat and drink, are they human being like us?” Abo Mohamad added finally
“The villages from where the buses of Shabiha left, and participated in the massacre:
Kaabiat Farish – Dier Albashl – Alanaza – Tairo – Almowred – Alasiba – Alzoba – Alquz in Baniyas – Aldalia – Taanita – Hraison – Kawkab Aala Albasatine – Sarbione – Alkaloaa – Barmaia – Bloza – along with many other villages that we couldn’t recognized.
The residents also recognized some families of those villages that their sons participated in the massacre:
Ahmad family – Mashraqi family – Aateki family – Ali family – Atek family – Jadid family – Shamali family – Hasan family – Saaod family – Zahraa family – Al Daiob family
They killed all the members of Rajab family, father, mother even children, in horrible ways: slaughtering, explosion heads, a girl called Iman from Rajab family stayed alive for a while, then she died affected her horrific wounds
Yasin family, Taha family, Suliman family, Husain family, Zarzour family, and many other families were wiped off the face of the earth
They raided the well known media activist’s house Ms. Baian Jaloul, who had a prominent role in transferring ongoing news and images. They took revenge and killed her in a very horrific way, they ripped her face with knifes, cut her nose, stomped on her hands and feet, slaughtered her, and left her dying in pain. She was transferring and publishing the news of what was happening
Her fiancé (also a media activist who worked together in Baniyas) came to her before she died, she asked him to drink water, then she died in his hands
Moments earlier, she wrote some of what she saw before she was killed: approximately at 6:43 PM until 6:50 pm:
” – Allahu Akbar – Allahu Akbar (God is the greatest – God is the greatest)

– They are pouring gasoline in houses and burning them
– Takebeer ( say God is the greatest)
– Extermination in Ras Alnabaa my friends
– Pray for us
– No one is helping us

An eyewitness told us that, because hatred and revenge: they were slaughtering children before their mothers’ eyes, then they slaughtered mothers and the rest of the families.
He also told us that they stabbed all the youths with knives and shot them with bullets
They didn’t allow doctors or paramedics or anyone else to enter the neighborhood at all, and for those who tried to enter, the snipes deployed in Alquz Alawite neighborhood thwarted them.
Then: Syrian Government’s Armed Forces looted houses and loaded electric and home devices into trucks, and emptied the contents of the houses then burned a large number of them.
On Saturday, May 4, 2013, and after the news of the ethnic cleansing massacre that took place in Ras Alnaaba neighborhood, Baniyas City experienced great displacement, when families arrived to the entrance of the other cities such as Jabla and Tartous, Syrian Government’s Armed Forces prevented them from entering, then they came back to the rural areas especially the Christian villages who embraced them and erected tents for them, opened the churches to housing them.

Sunday, May 5, 2013, again partial shelling on Ras Alnabaa sides, Syrian Government’s Armed Forces allowed for some families to entre, where governmental teams have washed by water tanks the blood and carnage, and they brought the official media to show that the village had been liberated from Al-Qaeda and terrorism
Monday, May 6, 2013, Syrian Red Crescent’s teams (SRC) escorted with Security forces and Shabiha entered the neighborhood and watched with the families the rotten corpses of women, children and men on the ground where the families were unable to bury them or even come close.
SRC escorted with Shabiha loaded dozens of corpses in four trucks using bulldozed, where they buried them in mass graves: tow trucks of corpses buried in an area known as Alnaznada and the other two trucks in the cemetery located in Almarqeb bridge.
This cemeteries well known for families and they can show it to any investigation commission

According to an eyewitnesses:
“In Ras Alnabaa in Banyias figures indicated that almost 200 victims were killed, and 100 are missing
The primary statistics are almost 600 victims, and 400 are missing unknown whether they were dead,arrested , or the bodies kidnapped by security forces”
One of the testimony in Ras Alnabaa said:
“I saw from my house’s window Shabiha while they were collecting corpses in the night in Ras Alnabaa Square and put them in bags then in cars and left the square”
Accounts of the massacre’s survivors
“When they started the attack of Ras Alnabaa few families hided in a basement dedicated to cattle fear of oppression and brutality of the regime, when the gangs finished committing their crimes, families started to check the deaths and saw what makes hair turning gray form rape, cutting organs, bodies’ distortion, they found few people still alive because they were half slaughtered to make the slaughtered suffering more ”
“I saw with my own eyes the family who survived from death by Shabiha, they told me that they heard their call with their leaders: we finished our mission successfully and we could eliminate them, when they came out of victims’ houses, they shot the deaths and their houses again”
Witness added ”[t]he witnesses told me that when they were burning houses and victims, they scattered yellow atoms with a very bad smell on the floors and on the victims, it cause tremendous fire within seconds, some of the equipments and mechanisms who involved in the attack demolished some walls to hide the burned bodies underneath while they were saying loudly Labaika Ya Husain – Lbaika Ya Assad ( Oh Assad, Oh Husain ”

Responsibility of States
Responsibility of States for Internationally Wrongful Acts
Responsibility of states for internationally wrongful acts, similarly Customary IHL provides that states that the state is responsible for all acts committed by a members of its military and security forces, thus the states is responsible of wrongful acts committed by its military and security forces including crimes against humanity
Prohibition crimes against humanity are among the rules of jus cogens or peremptory, and punish such crimes is compulsory according to the General principles of international law. Moreover, the crimes against humanity are the height violations of basic human rights, such as the right to life and prohibition of torture or other cruel, inhuman and degrading treatment. In accordance with the principles of State responsibility in international law, Syrian Arabic Republic hold responsibility for such crimes and violations, the duty to ensure punishment of the perpetrators individually and the duty to provide compensation to victims
SNHR hold all violations committed by Syrian Government Armed Forces to the Syrian government and the General Commander of the army and the armed forces, Bashar Al-Assad, and to all the officials of security branches, and to all financially and morally supporters to those forces, with the legal judicial and material consequences to the victims and their families in addition to all the reactions that will come by the families or their friends
Conclusions:
1- SNHR emphasizes that collective and individual killings as reported previously was deliberately targeted unarmed civilians, despite government claims that Alqaeda and terrorists committed these crimes, thus Syria Government’s Armed Forces and Shabiha violated international human rights law that protects the right of life, along with being committed in non-international armed conflicts a crimes tantamount to war crimes and had all the conditions
2- SNHR emphasizes that the killings that occurred in Baniyas are crimes against humanity, and elements of systematic and widespread attack against civilian population in the town, where there were a siege, shelling, ground attack, house searches, executions
The same applies on rape, kidnapping, looting and thefts even it is relatively less than Extrajudicial killings.
3- Random Attacks committed by Syrian Government’s Armed Forces considered as violation of customary international humanitarian law, where they shelled a populated areas not a specific military target
4- Those attacks, especially bombings, have caused occasional losses of civilian life, injury or damage to civilian objects. There are very strong indications to believe that the damage was too excessive when compared to the expected military advantage.
5- Syrian Government’s Armed Forces and Shabiha committed various types of cruel and inhuman acts of torture against people in violation of the State’s obligations under international humanitarian law and international human rights law
6- SNHR emphasis that Syrian Government’s Armed Forces and Shabiha war crime of looting. And contributed to the destruction and burning of property during searches of homes in the events of Baniyas.
7- The volume of the massacre and repeated nature of the massacres, the excessive force used and random nature of the shelling and coordinated nature of the attack couldn’t be unless under the higher guidance which is a state policy
Recommendations :
Syrian Government
1- Immediately stop all human rights’ violations.
2- Respect international obligations of protection of civilians in time of war, and respect the rules of international humanitarian law and international human rights law
Human Rights Council:
1- Demand the Security Council and the concerned international institutions to hold their responsibilities of what’s happening for the Syrian People of killing, rape, displacement, and arrested
2- Pay more serious attention to torture-death cases which considered as the worst type of crimes at all
3- Pressure the Syrian Government Troops to stop torturing and killing and release all kidnapped and arrested
4- Hold allies and supporters of the Syrian Government Troops: Russia, Iran and China, the morally and physically responsible for what’s happening to the Syrian people
Security Council:
1- Decide to refer all the criminals and the involved to ICC
2- Warn the Syrian Government Troops of the repercussions for using brutal methods on the stability of civil peace and coexistence between the people of the same society
Arab League:
1- Demand Human Right Council and United Nations to give a serious and right attention of stop daily killing
2- Political and diplomatic pressure on the Syrian Government Troops ‘s main allies – Russia, Iran andChina-to prevent them from continuously providing cover and international and political protection for all the crimes committed against the Syrian people and hold them morally and physically responsible for all the excesses of the Syrian Government Troops
3- Serious attention of this case and give it a high priority, and try to take care of victims’ families psychologically, materially, and educationally
